Welcome to buildAnest. These Terms and Conditions ("Terms") govern your use of our website buildanest.in ("Platform") and the construction services we provide. By accessing or using our Platform and services, you agree to be bound by these Terms.

1. Definitions

For the purposes of these Terms:

• "We," "Us," "Our," or "buildAnest" refers to buildAnest, a construction service provider operating in India.
• "You," "Your," or "User" refers to the individual or entity accessing our Platform or using our services.
• "Services" refers to all construction, design, consultation, and related services provided by buildAnest.
• "Platform" refers to our website, mobile application, and any other digital interface we provide.
• "Project" refers to any construction or renovation work undertaken by buildAnest for a User.

2. Acceptance of Terms

By using our Platform or engaging our services, you confirm that:

• You are at least 18 years of age and legally capable of entering into binding contracts
• You have read, understood, and agree to these Terms
• You have the authority to bind any entity you represent to these Terms
• All information you provide is accurate, current, and complete

3. Services Offered

buildAnest provides the following services:

• Residential construction and renovation
• Commercial construction projects
• Interior design and decoration
• Architectural consultation
• Project planning and management
• Material procurement and supply

All services are subject to availability, feasibility assessment, and mutual agreement between buildAnest and the User.

4. Use of the Platform

Permitted Use

You may use our Platform for:

• Browsing information about our services
• Requesting consultations and quotations
• Communicating with our team
• Managing your construction projects
• Making payments for services rendered

Prohibited Activities

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Platform's functionality
• Upload malicious code, viruses, or harmful content
• Copy, reproduce, or distribute our content without permission
• Impersonate buildAnest or any of its representatives
• Use automated systems to scrape or collect data from the Platform
• Submit false or misleading information

5. Project Engagement and Quotations

Consultation and Quotation

When you request our services:

• We will schedule a consultation to understand your requirements
• We will conduct a site visit and feasibility assessment (if required)
• We will provide a detailed quotation outlining the scope, timeline, and cost
• The quotation is valid for 30 days unless otherwise specified

Project Agreement

Upon acceptance of the quotation:

• A formal project agreement will be executed between buildAnest and the User
• The agreement will specify deliverables, timelines, payment terms, and responsibilities
• Both parties must sign the agreement before work commences
• Any changes to the project scope must be documented in writing

6. Payment Terms

Payment Schedule

Unless otherwise agreed in the project agreement:

• Advance Payment: 20-30% of the total project cost is payable upon signing the agreement
• Milestone Payments: Payments are linked to project milestones as outlined in the agreement
• Final Payment: The remaining balance is due upon project completion and handover

Payment Methods

We accept the following payment methods:

• Bank transfer (NEFT/RTGS/IMPS)
• Cheque or demand draft
• Online payment gateways (credit/debit cards, UPI, wallets)

Late Payments

Late payments may result in:

• Suspension of work until payment is received
• Interest charges as per the project agreement
• Termination of the project (in case of prolonged non-payment)

7. Project Timeline and Delays

We strive to complete projects within the agreed timeline. However, delays may occur due to:

• Unforeseen site conditions
• Changes in project scope requested by the User
• Delays in obtaining government approvals or permits
• Material shortages or supply chain disruptions
• Adverse weather conditions
• Force majeure events (natural disasters, pandemics, etc.)

We will notify you promptly of any delays and work to minimize their impact. buildAnest shall not be liable for delays caused by factors beyond our reasonable control.

8. Changes to Project Scope

Any changes to the project scope must be:

• Requested in writing by the User
• Assessed for feasibility and impact on timeline and cost
• Approved by both parties through a written change order
• Incorporated into the project agreement with revised terms

Changes may result in additional costs and extended timelines.

9. Warranties and Guarantees

Workmanship Warranty

We provide a warranty on our workmanship for a period specified in the project agreement (typically 1-2 years from project completion). This warranty covers defects arising from poor workmanship, excluding:

• Normal wear and tear
• Damage caused by misuse or negligence
• Unauthorized modifications or repairs by third parties
• Acts of God or force majeure events

Material Warranty

Materials are covered by manufacturer warranties. We will assist in warranty claims but are not responsible for manufacturer defects.

10. Limitation of Liability

To the fullest extent permitted by law:

• buildAnest's liability is limited to the total amount paid by the User for the specific project
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for delays or issues caused by third-party contractors, suppliers, or government agencies
• We are not liable for damages resulting from User's failure to provide accurate information or timely approvals

11. Intellectual Property

All content on our Platform, including designs, logos, text, images, and software, is the property of buildAnest and is protected by intellectual property laws. You may not:

• Reproduce, distribute, or modify our content without permission
• Use our trademarks or branding without authorization
• Create derivative works based on our content

Custom designs created for your project remain your property upon full payment.

12. Privacy and Data Protection

We are committed to protecting your privacy. Our collection, use, and disclosure of personal information is governed by our Privacy Policy. By using our services, you consent to our privacy practices.

13. Termination

Termination by User

You may terminate the project agreement by providing written notice. Termination charges will apply as per the project agreement, including:

• Payment for work completed up to the termination date
• Reimbursement for materials procured
• Cancellation fees (if applicable)

Termination by buildAnest

We reserve the right to terminate the project agreement in case of:

• Non-payment or breach of payment terms
• Breach of these Terms or the project agreement
• Unsafe site conditions
• Unreasonable delays caused by the User

14. Dispute Resolution

In the event of any dispute arising from these Terms or our services:

• Both parties agree to first attempt resolution through good-faith negotiations
• If negotiations fail, disputes will be resolved through mediation
• If mediation fails, disputes will be subject to arbitration in accordance with Indian law
• The courts of Bengaluru, India shall have exclusive jurisdiction

15. Force Majeure

Neither party shall be liable for failure to perform obligations due to events beyond reasonable control, including:

• Natural disasters (earthquakes, floods, storms)
• Pandemics or health emergencies
• War, terrorism, or civil unrest
• Government actions or regulatory changes
• Strikes or labor disputes

16. Indemnification

You agree to indemnify and hold buildAnest harmless from any claims, damages, or expenses arising from:

• Your breach of these Terms
• Your violation of any laws or regulations
• Inaccurate information provided by you
• Unauthorized use of our Platform or services

17. Amendments to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on our Platform. Your continued use of our services after changes constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with the project agreement and Privacy Policy, constitute the entire agreement between you and buildAnest regarding the use of our Platform and services.
